There has been a recent increase in the number of recalls by the United States Consumer Products Safety Commission related to bicycles. All recalls are serious, but those involving bicycles are of particular urgency because the rider of a bicycle often is traveling at a fast speed, down difficult conditions, and is relatively unguarded from injury.
A defective bicycle or bicycle-related product that leads to an injury may be the basis for a product liability claim under Illinois law. In Illinois, an injured person may pursue under the doctrine of "Strict Product Liability" when a) an unreasonably dangerous condition or defect existed in the product, b) the condition or defect at the time the product left the manufacturer's control, and the condition was the primary cause of the rider's injury. Keating Law Offices offers free, no obligation reviews of product liability cases. All consultations are completely confidential.
